1) Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of Dreambeau's websites, apps, and related services (the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

2) Who we are and how to contact us

Dream Technologies Labs, Inc. (a Delaware corporation, doing business as "Dreambeau") operates the Service. In these Terms, "Dreambeau", "we", "us", and "our" refer to Dream Technologies Labs, Inc.

Service domains include dreambeau.ai and related product subdomains (including app.dreambeau.ai).

3) Eligibility and age requirement

You must be 18 or older to use the Service. By using the Service, you confirm that you are at least 18.

4) The Service and AI-generated content

Dreambeau provides AI-powered companion experiences. The Service may generate content automatically using machine learning systems. AI-generated content can be incorrect, incomplete, misleading, or inappropriate.

You understand and agree:

• AI responses are for entertainment and general informational purposes only.
• You should use your own judgment and verify important information.
• Do not rely on the Service for professional advice (medical, legal, financial, mental health, or safety-critical matters).

5) Account registration and security

You may need to create an account to use parts of the Service. You are responsible for:

• Providing accurate information,
• Maintaining the confidentiality of login credentials or verification links/tokens,
• All activity that occurs under your account.

Notify us promptly at support@dreambeau.ai if you suspect unauthorized access.

6) Subscriptions, billing, and cancellation

Some features require a paid subscription. Subscription options, pricing, and billing intervals are shown at checkout.

Billing and renewal

• Subscriptions are billed in advance and automatically renew until cancelled.
• By starting a subscription, you authorize us (and our payment processor) to charge the recurring subscription fee, plus any applicable taxes.

Cancellation

• You can cancel at any time. Cancellation takes effect at the end of the current billing period unless otherwise stated at checkout.
• If you cancel, you will retain access to paid features until the end of the paid period (unless your access is terminated for cause).

Refunds

• Fees are non-refundable except where required by law or expressly stated at checkout.
• If the Service is considered a digital service or digital content in your jurisdiction, you request immediate access and acknowledge that the right to cancel may be limited once performance begins, to the extent permitted by law.

Changes

We may change subscription fees, plans, or features. If changes affect your subscription, we will provide reasonable notice. Continued use after changes take effect means you accept the changes.

Fair use and abuse protection

To protect service quality and prevent abuse, we may apply usage limits, automated protections, and temporary restrictions to accounts or requests that create abnormal load or violate these Terms.

Usage limits and anti-abuse controls may change over time as the Service evolves.

7) Acceptable use

You agree not to misuse the Service. You must not:

• Use the Service for illegal activity or to violate applicable laws,
• Generate or share content that is exploitative, abusive, harassing, hateful, or sexually exploitative,
• Create, request, or distribute content involving minors in any sexual context,
• Attempt to reverse engineer, scrape, or disrupt the Service, or bypass protections,
• Use the Service to spam, phish, or distribute malware,
• Use the Service in a way that could reasonably cause harm to others.

We may suspend or terminate accounts that violate these rules.

8) User content and permissions

You may provide text, images, or other materials to the Service ("User Content"). You retain ownership of your User Content as between you and Dreambeau.

To operate the Service, you grant Dreambeau a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display your User Content, solely to:

• Provide and maintain the Service,
• Personalize your experience,
• Enforce safety and policy rules,
• Improve the Service.

You represent that you have the rights necessary to provide User Content and that it does not violate law or third-party rights.

9) Proactive messaging and notifications

The Service may allow companions to initiate messages or suggestions. By using these features, you authorize companion-initiated communications through the Service.

You can control proactive behavior in settings (for example, pause initiatives, frequency controls, and related options where available).

If push notifications are enabled on your device, notification previews may appear on your lock screen based on your device settings.

10) Safety, moderation, and enforcement

We may use automated systems and, in limited cases, human review to:

• Detect abuse or policy violations,
• Enforce safety measures,
• Maintain quality and reliability.

We may remove content, restrict features, suspend, or terminate accounts if we believe it is necessary to protect users, Dreambeau, or the public.

11) Intellectual property

The Service (including software, designs, branding, and generated companion experiences as presented by Dreambeau) is owned by Dreambeau or its licensors and is protected by intellectual property laws.

Except for the limited rights necessary to use the Service, no rights are granted to you.

12) Third-party services

The Service may integrate third-party services (for example, payment processors). Your use of third-party services may be governed by their separate terms and privacy policies.

13) Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREAMBEAU DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Dreambeau does not guarantee that the Service will be uninterrupted, error-free, or that any AI-generated output will be accurate or suitable for your needs.

14) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• DREAMBEAU WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
• DREAMBEAU'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DREAMBEAU FOR THE SERVICE IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$50.

Nothing in these Terms limits liability that cannot be limited under law (for example, fraud or certain consumer rights).

15) Indemnity

You agree to indemnify and hold Dreambeau harmless from claims, liabilities, damages, and expenses arising out of your misuse of the Service, your User Content, or your violation of these Terms or applicable law.

16) Termination

You may stop using the Service at any time.

We may suspend or terminate your access if:

• You violate these Terms,
• We reasonably believe continued access risks harm, abuse, or legal exposure,
• We must do so to comply with law.

Upon termination, your right to use the Service ends. Sections that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, indemnity, and dispute terms).

17) Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice (for example, via the Service). Continued use after changes take effect means you accept the updated Terms.

18) Governing law and venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. To the extent permitted by law, you and Dream Technologies Labs, Inc. agree that any dispute arising from or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, except where applicable consumer protection laws require otherwise.
